Peru: Constitutional Court rejects incorporation of Gonzalo Ortiz de Zevallos Olaechea

The Peruvian Constitutional Court (TC) on Thursday rejected the incorporation of Gonzalo Ortiz de Zevallos Olaechea as a member of this body.

At a plenary session, Judges Marianella Ledesma, Eloy Espinosa-Saldaña, Ernesto Blume, Carlos Ramos Nuñez, and Manuel Miranda voted against the incorporation of Ortiz de Zevallos Olaechea as a new tribune.

For their part, Jose Luis Sardon and Augusto Ferrero Costa voted in favor of the lawyer.

In a controversial voting session —held on September 30— the former Congress elected Ortiz de Zevallos Olaechea to become part of the body, despite the fact that the Executive Branch had previously requested the Legislative —through a confidence motion— to change the modality used to select the court members.

According to the TC, the next Congress —to be elected by the citizens on January 26, 2020— must resolve the objections regarding the September voting session presented by some ex-lawmakers who claimed that the election process of said lawyer had not been finished.

As is known, the Constitutional Court is entrusted with upholding the principle of constitutional supremacy, as it has the authority to review the adequacy of laws, draft laws, and decrees issued by the powers of government.
